1. Acceptance of Terms
By booking any trek, tour, yoga retreat, or service with Shivashakti Yoga Treks ("we", "us", "our"), you ("client", "guest", "participant") agree to be bound by these Terms and Conditions. Please read them carefully before making a booking. If you do not agree with any part of these terms, please do not book our services.
2. Booking and Confirmation
2.1 How to Book
You can make a booking by:

2.2 Confirmation
Your booking is confirmed only after:
You have completed the booking form with all required information (name, passport details, emergency contact, medical conditions, etc.)
You have paid the required deposit (see Section 5)
You have received a written confirmation from us via email or WhatsApp
2.3 Information Required
For trekking bookings, we require the following information at least 7 days before the trek start date:
Full name as on passport
Passport number and copy
Date of birth
Nationality
Emergency contact name, relationship, and phone number
Any medical conditions, allergies, dietary restrictions
Travel insurance policy number and emergency assistance contact
3. Age and Fitness Requirements
3.1 Minimum Age
Minimum age for trekking is 18 years (or 16 years with guardian consent and accompaniment)
There is no maximum age limit, but participants must have good physical fitness
3.2 Fitness Level
You must be in good physical and mental health to participate in our treks
You are responsible for assessing your own fitness level
We reserve the right to refuse participation to anyone we believe is unfit for the trek
3.3 Medical Conditions
You must disclose any medical conditions that may affect your ability to complete the trek, including but not limited to:
Heart conditions
Respiratory issues (asthma, COPD)
Diabetes
Epilepsy or seizure disorders
Joint or mobility issues
Pregnancy
Mental health conditions
Any medication you are taking
Failure to disclose relevant medical conditions may result in cancellation of your participation without refund.
4. Travel Insurance (Mandatory)
4.1 Insurance Requirements
Comprehensive travel insurance is MANDATORY for all treks. Your insurance must cover:
Emergency helicopter evacuation (minimum coverage of 5,000−5,000−10,000)
Medical expenses and hospitalization (minimum $50,000)
Trip cancellation and interruption
Lost, stolen, or damaged baggage and personal items
Flight delays and cancellations
Adventure activities including trekking up to 5,500 meters altitude
4.2 Proof of Insurance
You must provide proof of valid travel insurance before the start of the trek. We will ask for:
Insurance provider name and policy number
24-hour emergency assistance phone number
Coverage limits for medical evacuation and medical expenses
4.3 No Insurance = No Trek
If you cannot provide proof of valid insurance, we reserve the right to deny your participation without refund.
5. Pricing and Payment
5.1 Pricing
All prices quoted are in US Dollars (USD) or Nepalese Rupees (NPR) as indicated. Prices are subject to change without notice, but once your booking is confirmed, the price is guaranteed.
5.2 Deposit
A deposit of 20% of the total package price is required at the time of booking
The deposit is non-refundable (see Section 7 for cancellation policy)
5.3 Balance Payment
The remaining balance must be paid before the start of the trek
Payment can be made by cash (USD or NPR), bank transfer, or credit card (3-4% service charge applies for credit cards)
5.4 Accepted Payment Methods
Cash: Nepalese Rupees (NPR) or US Dollars (USD) - accepted at our office
Bank Transfer: To our Nepali bank account (details provided upon booking)
Credit Card: Visa, Mastercard (additional 3-4% fee applies)
Online Payment: Via our payment link (additional fees may apply)
6. Included and Not Included
6.1 What is Included
Accommodation during the trek (teahouse/lodge, twin-sharing)
All vegetarian meals during the trek (breakfast, lunch, dinner)
Trekking permits (TIMS card and ACAP permit)
Experienced English-speaking trekking guide
Certified yoga teacher
Private transportation from Pokhara to trek start point and return
60-minute Ayurvedic Deep Tissue Massage (after the trek)
Basic first aid kit
All government taxes and service charges
6.2 What is Not Included
Domestic or international flights
Nepal visa fees (available on arrival at airport - $30-100 depending on duration)
Travel insurance (mandatory)
Meals in Pokhara (except as specified in package)
Accommodation in Pokhara before or after trek (unless specified in package)
Personal expenses (snacks, soft drinks, alcoholic beverages, laundry, phone calls, etc.)
Hot showers during trek ($2-5 per shower - payable directly to teahouse)
Battery charging during trek ($1-3 per device - payable directly to teahouse)
Wi-fi during trek ($2-5 per day - payable directly to teahouse)
Tips for guide, yoga teacher, and porters (recommended but not mandatory)
Personal trekking gear (shoes, jacket, backpack, sleeping bag, trekking poles, etc.)
Emergency evacuation costs (covered by your insurance)
7. Cancellation and Refund Policy
7.1 Cancellation by Client

7.2 Cancellation by Shivashakti Yoga Treks
We reserve the right to cancel any trek due to:
Insufficient number of participants (minimum 2 participants)
Unforeseen circumstances (natural disasters, political unrest, strikes, weather conditions, etc.)
Safety concerns
In such cases, we will offer:
Full refund of all payments made, OR
Rescheduling to a future date at no additional cost, OR
Credit voucher valid for 12 months
7.3 Partial Cancellation
If you choose to leave a trek early for any personal reason (illness, injury, discomfort, personal emergency, etc.), no refund will be provided for unused portions of the trek.
8. Itinerary Changes
8.1 Right to Modify
We reserve the right to modify the itinerary due to:
Weather conditions (heavy rain, snow, landslides, poor visibility)
Trail conditions (blocked trails, bridge damage, landslides)
Health or safety concerns (client illness, altitude sickness, injuries)
Government restrictions or permits issues
Natural disasters or political unrest
8.2 Alternative Arrangements
If an itinerary change is necessary, we will make reasonable alternative arrangements to ensure your safety and experience. No refunds will be provided for changes due to circumstances beyond our control (force majeure).
9. Health and Safety
9.1 Responsibility for Own Health
You are responsible for your own health and well-being during the trek. You must:
Inform your guide immediately of any health concerns or symptoms
Stay hydrated and eat adequately
Follow your guide's instructions regarding pace and rest breaks
Not hide or minimize symptoms (especially altitude sickness symptoms)
9.2 Altitude Sickness
Altitude sickness can affect anyone regardless of age, fitness level, or previous high-altitude experience. You agree to:
Report any symptoms (headache, nausea, dizziness, fatigue, shortness of breath) to your guide immediately
Descend immediately if your guide recommends it for safety
Accept that the guide's decision regarding altitude-related descent is final
Refusal to descend when recommended by the guide will result in you being left behind (with a porter or assistant if available) at your own risk and expense.
9.3 Medical Emergencies
In case of medical emergency:
The guide will coordinate with our office for evacuation if needed
Emergency helicopter evacuation will be arranged if required
All costs for evacuation, hospitalization, and medical treatment are your responsibility (covered by your travel insurance)
We will assist in coordinating with your insurance provider
10. Liability and Risk Acknowledgement
10.1 Assumption of Risk
Trekking in Nepal involves inherent risks and dangers, including but not limited to:
High altitude and associated health risks (including altitude sickness, HAPE, HACE)
Rough, uneven, steep, and slippery terrain
Weather extremes (cold, rain, snow, wind, sun exposure)
Landslides, rockfalls, and avalanches
River crossings on suspension bridges
Remote locations with limited medical facilities
Wildlife encounters
Physical exertion and fatigue
By booking with us, you acknowledge and accept these risks.
10.2 Limitation of Liability
To the maximum extent permitted by law, Shivashakti Yoga Treks and its employees, guides, yoga teachers, and agents shall not be liable for:
Personal injury, illness, disability, or death
Loss or damage to personal property
Delays, inconveniences, or expenses due to circumstances beyond our control
Emotional distress or mental suffering
Our total liability shall not exceed the amount paid by you for the specific trek or service.
10.3 Guide's Authority
The trekking guide has the final authority on all decisions regarding:
Daily pace and rest breaks
Itinerary changes due to safety concerns
Acclimatization schedules
Decisions to descend due to altitude sickness or illness
Trail and route selection
You agree to follow your guide's instructions at all times.
11. Permits and Documentation
11.1 Permit Responsibility
We will obtain all necessary trekking permits on your behalf:
TIMS (Trekkers' Information Management System) card
ACAP (Annapurna Conservation Area Permit)
11.2 Required Documents
You must provide:
Valid passport (minimum 6 months validity)
Passport-sized photos (2 copies)
Copy of your travel insurance policy
11.3 Lost or Stolen Permits
If you lose your permit during the trek, we will assist in obtaining a replacement at your own expense. Without a permit, you may be fined or prohibited from continuing the trek.
12. Behavior and Conduct
12.1 Respect for Local Culture
You agree to:
Dress modestly when walking through villages (cover shoulders and knees)
Ask permission before taking photographs of local people
Respect local customs, traditions, and religious sites
Not consume alcohol or drugs during the trek (except as prescribed medication)
12.2 Environmental Responsibility
You agree to follow Leave No Trace principles:
Carry all non-biodegradable waste (plastic, batteries, sanitary products) out of the mountains
Use designated toilets (not open defecation)
Do not litter on trails or in teahouses
Do not disturb wildlife or pick flowers/plants
12.3 Group Conduct
You agree to:
Be respectful to fellow trekkers, guides, yoga teachers, porters, and teahouse staff
Not create excessive noise, especially at night
Not smoke in teahouse dining rooms or dormitories (outdoors only, away from others)
Not use drugs or excessive alcohol
Follow teahouse rules regarding shoes, dining, and sleeping areas
We reserve the right to remove any client from a trek for disruptive, disrespectful, or unsafe behavior. No refund will be provided in such cases.
13. Yoga Sessions
13.1 Participation
Yoga sessions are optional but encouraged. You may choose to:
Participate fully
Modify poses as needed (instructor will provide modifications)
Rest or observe if you are tired or unwell
13.2 Physical Limitations
You must inform the yoga teacher of any:
Injuries or recent surgeries
Pregnancy
Chronic conditions (back pain, joint issues, etc.)
Any other limitations
13.3 Liability
You participate in yoga sessions at your own risk. The yoga teacher is not responsible for injuries sustained during practice. Listen to your body and do not push beyond your limits.
14. Accommodation
14.1 Teahouse Conditions
Teahouses are basic mountain lodges. You should expect:
Twin-sharing rooms (two single beds)
Shared bathroom facilities (squat or western toilets)
Limited or no hot water (hot showers available for extra fee)
Basic bedding (mattress, pillow, blanket)
No heating in rooms (communal dining area has a stove)
No electricity in rooms (charging available in dining area for fee)
No attached bathroom in most teahouses
14.2 Single Rooms
Single rooms are available on request for an additional fee (approximately $5-15 per night depending on availability). During peak season, single rooms cannot be guaranteed.
14.3 Room Allocation
We will allocate rooms based on availability. Solo travelers may be paired with another guest of the same gender unless a single room is requested and paid for.
15. Meals
15.1 Meal Times
Typical meal schedule during trek:
Breakfast: 7:00 AM - 8:00 AM
Lunch: 12:00 PM - 1:00 PM (at teahouse en route)
Dinner: 6:00 PM - 7:00 PM
15.2 Food Options
All meals are vegetarian. Options include:
Breakfast: Oatmeal, muesli, pancakes, omelets, Tibetan bread, chapati
Lunch/Dinner: Dal bhat, noodles, fried rice, momos, soups, pasta, potato dishes
Drinks: Tea (black, milk, ginger, lemon honey), coffee, hot chocolate, hot lemon
15.3 Dietary Restrictions
We can accommodate:
Vegan
Gluten-free
Dairy-free
Jain (no onion, no garlic)
Please inform us at least 2 weeks before the trek. We cannot guarantee strict adherence in remote areas due to limited ingredients.
16. Tips and Gratuities
Tipping is customary in Nepal but not mandatory. Recommended amounts:

Tips are typically given at the end of the trek. You may give directly to each staff member or pool tips with fellow trekkers.
17. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms and Conditions if such delay or failure is caused by events beyond our reasonable control, including but not limited to:
Natural disasters (earthquakes, floods, landslides, avalanches, storms)
War, civil unrest, terrorism, or political instability
Government restrictions, strikes, or lockouts
Epidemic or pandemic (including COVID-19 related restrictions)
Flight cancellations or delays due to weather
Road closures or trail blockages
No refunds will be provided for trips interrupted or cancelled due to force majeure events.
18. Photography and Marketing
18.1 Use of Images
We may take photographs or videos during your trek for marketing and promotional purposes (website, social media, brochures). We will ask for your explicit consent before using any image that clearly identifies you.
18.2 Withdrawal of Consent
You may withdraw your consent at any time by contacting us. Withdrawal will apply to future use only (we cannot remove images already published in print materials).
19. Complaints and Dispute Resolution
19.1 On-Trek Complaints
If you have a complaint during the trek, please inform your guide immediately. Most issues can be resolved on the spot.
19.2 Post-Trek Complaints
Any complaint after the trek must be submitted in writing within 14 days of the trek end date to sagaracharya034@gmail.com. We will investigate and respond within 14 business days.
19.3 Governing Law
These Terms and Conditions are governed by the laws of Nepal. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Pokhara, Nepal.
20. Amendments
We reserve the right to amend these Terms and Conditions at any time. The most current version will be posted on our website or provided upon request. Your continued use of our services after any amendments constitutes acceptance of the updated terms.

By booking a trek or service with Shivashakti Yoga Treks, you acknowledge that:
You have read, understood, and agree to be bound by these Terms and Conditions.
You have disclosed all relevant medical conditions.
You will obtain the required travel insurance before the trek.
You accept the inherent risks of trekking in Nepal.
You will follow your guide's instructions at all times.
You understand that no refund will be provided for early departure or itinerary changes due to safety concerns.
